Fire Ave is an independent music platform that connects artists directly with listeners, allowing artists to retain 85% of their earnings from music sales.

2. Eligibility

You must be at least 13 years old to use Fire Ave. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using Fire Ave, you represent and warrant that you have the legal capacity to enter into a binding agreement.

To access certain features of Fire Ave, you must create an account. When registering, you agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or use

By uploading content to Fire Ave, you agree that your content:

• Does not promote violence, discrimination, or illegal activities
• Complies with all applicable laws and regulations

Fire Ave reserves the right to remove any content that violates these guidelines without prior notice.

Artists retain full ownership of their original content. By uploading content to Fire Ave, you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and distribute your content solely for the purpose of operating and promoting the Service.

Fire Ave and its logos, trademarks, and service marks are the property of Fire Ave. You may not use our branding without prior written permission.

7. Payments and Earnings

Fire Ave processes payments through secure third-party payment processors (Stripe and PayPal). By making purchases or receiving payments through Fire Ave:

• Artists receive 85% of net sales revenue after payment processing fees
• Minimum payout threshold is $10 USD
• Payouts are processed within 7-14 business days of request
• Artists are responsible for reporting earnings for tax purposes
• All sales are final; refunds are handled on a case-by-case basis

8. DMCA and Copyright Claims

Fire Ave respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please submit a DMCA takedown notice to our designated agent with the following information:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material on Fire Ave
• Your contact information (name, address, phone number, email)
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

9. Subscriptions

Fire Ave offers various subscription tiers for both artists and listeners. Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

10. Prohibited Conduct

You agree not to:

• Use bots, scripts, or automated methods to artificially inflate play counts
• Attempt to circumvent any security features or access restrictions
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Harvest or collect user information without consent
• Use the Service for any illegal purpose
• Resell or redistribute content without authorization

11. Termination

Fire Ave may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FIRE AVE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY CONTENT UPLOADED BY USERS OR ANY DISPUTES BETWEEN USERS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRE AVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FIRE AVE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Fire Ave reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of Fire Ave after such changes constitutes acceptance of the new Terms.
